It's important to know that a written employment contract is not mandatory in Morocco. It is one way of providing proof among others, such as witness testimonies from colleagues. During the trial period, a notice period is required if the employee works at least one week.

1. Definition

This is the period during which both the employee and employer may terminate the employment contract. If the employee works for at least one week, a notice period is required:

  • Two days for non-monthly paid employees;
  • Eight days for monthly paid employees;
  • Eight days at the end of the trial period.

2. Duration of the trial period

It is defined according to the type of contract. In the case of a permanent contract (CDI), the trial period can be renewed only once. It is:

  • 3 months for executives and similar positions;
  • 1 month for employees;
  • 15 days for workers.

In the case of a fixed-term contract (CDD), the duration of the trial period is:

  • One day per week for contracts of less than 6 months, not exceeding two weeks;
  • One month for contracts of more than 6 months.
