Employment Contract Termination

First, in Morocco, a written employment contract is not mandatory. It is one means of proof among others, such as witness testimony from colleagues. During the trial period, notice is required if the employee works for at least one week.

1. Fixed-term contracts (CDDs) end (article 33 of the labor code) by:

  • Reaching the contract expiry date;
  • Completion of the work defined in the contract.

Termination before the expiry date leads to damages unless there is gross misconduct or force majeure. Compensation is equal to the amount of salaries corresponding to the period from the date of termination to the date specified in the contract.

2. Permanent contracts (CDIs) end (article 34 of the labor code) by:

  • The employer's decision, subject to certain conditions;
  • The employee's decision, through a signed and legalized resignation.
